I won’t be changing my personal name to DomainNameWire.com anytime soon. Here’s an interesting court decision handed down by the Court of Appeal in California. Robert Edward Forchion, Jr., a self proclaimed “dedicated marijuana lover”, wanted to change his statutory name to NJWeedman.com

Kohler Files Cybersquatting Lawsuit Against Repeat Offenders

After paying off cybersquatters, Kohler says it got burned. Plumbing fixtures giant Kohler has filed an anticybersquatting lawsuit against a company that it had already paid to stop registering its trademarks as domain names. The federal district suit was filed against DomainJet, Inc, Jack Sun, and one or more of the company’s employees. According to Kohler, it approached the defendants after it noticed they registered Kohlerco.in.

Above.com In Settlement Talks with Verizon

Domain company working toward settlement over trademark lawsuit. Above.com is currently in settlement talks with Verizon over a lawsuit brought by Verizon in February, according to court records. Verizon filed the suit against Above.com, parent company Trellian, and some of its key employees back in February. It also served the company during DOMAINfest. The complaint alleges that the defendants use a number of false identities to traffic in trademark-infringing domain names

WIPO’s headline is misleading. Today World Intellectual Property Forum (WIPO) did its annual release of how many UDRP cases it handled last year. It was a record 2,696 cases. That’s a lot of cases, and National Arbitration Forum also saw an increase in cases this year. But I take issue with WIPO’s headline: Cybersquatting Hits Record Level A more accurate headline would be Cybersquatting Enforcement Hits Record Level.

Woman With World’s Smallest Waist Wins Cybersquatting Lawsuit

A domain name is a terrible thing to waist . Cathie Jung, who is in the Guinness Book of World Records as having “ The Smallest Waist on a Living Person ” at 15 inches, has won rights to the domain name CathieJung.com. Jung filed an Anticybersquatting Consumer Protection Act en rem (meaning it was against the domain name and not the registrant) case back in December 2009. Jung claimed that the domain name was registered by a corset designer.

John Zuccarini vs Office Depot, Collecting On An Old Judgment

John Zuccarini is back in the news fighting against the collection of a judgment by DS Holdings . DSH has been assigned a judgment by Office Depot from 2000 and is seeking to collect by seizing domain names.  Zuccarini was found guilty of cybersquatting on Office Depot’s trademark with the domain officdepot.com.  In the discovery process DSH has found that Zucarrini owns 248 domains and is seeking to levy these domains and sell them at auction to collect on the judgment. In 2007, the US District Court for the Northern District of California ruled that Zuccarini’s domain names constituted personal property located in California—the site of the domain name registry—and were subject to seizure to satisfy the judgment against Zuccarini.  DSH moved to have a receivership assist in executing the judgment in the Northern District of California
