Manwin’s Attack on .XXX is Really an Attack on New TLDs

Arguments and antitrust lawsuit could be made against many top level domain names. Manwin Licensing, the company behind YouPorn, has sued .xxx registry ICM Registry for violating the Sherman Act (i.e. monopoly). If you read the complaint against ICM you could substitute other top level domains for .xxx and the suit would still make sense. Manwin says .xxx wasn’t put out to competitive bid, has no price caps, and ICM Registry gets presumptive renewal.

Group to help set policy for new .xxx domain name. One of the interesting quirks about the new .xxx domain name is that it will help fund a group called International Foundation for Online Responsibility (IFFOR). IFFOR will get $10 from every domain registration in order to initiate “a series of policies for responsible business practices and conduct within the .XXX online adult-entertainment community”. Today the group sent out a press release formally announcing the members of the IFFOR board as well as initial members of its Policy Council. Board members include: Stuart Lawley – CEO of ICM Registry, which is running .xxx Clyde Beattie – CEO of Yorkland Investment Corp Sebastien Bachollet, CEO of BBS Consulting and a member of the Board of Directors of ICANN Policy Council members include: Fred Cate – Professor of Law at the Indiana University School of Law-Bloomington and director of the Indiana University Center for Applied Cybersecurity Research Bob Corn-Revere, Partner at Davis Wright Tremain Nadine Strossen – Served as president of ACLU from 1991 through 2008 Five more Policy Council members will be announced within the next couple months.

.XXX Goes Live in the Root Servers

Earlier today href="http://www.iana.org/domains/root/db/xxx.html">IANA added the .XXX Top Level Domain to the root nameservers. While the registry operator href="http://www.afilias.info/">Afilias is still in their setup process for href="http://www.icmregistry.com/"> ICM registry, the zone is currently propagating. While a number of registrars have already been taking pre-registrations, the href="http://www.icmregistry.com/about/sunrise.php">actual timeline for the launch has not yet been published. The Sunrise launch is a three phased approach. After much href="http://www.domainnamenews.com/up-to-the-minute/icann-delays-xxx-decision/7315">back and forth and href="http://www.domainnamenews.com/icann-policy/free-speech-coalition-lobby-xxx-tld-icann-meeting/7768">protests against the sTLD the href="http://www.icann.org/en/minutes/resolutions-18mar11-en.htm#5">ICANN board had approved the application for the new TLD at their meeting on March 18th of this year.

[Update] As href="http://domainincite.com/xxx-domains-go-live/">Kevin over at DomainIncite points out in his post on the same topic, the href="http://icmregistry.xxx/">registry website, href="http://sex.xxx/">sex.xxx and href="http://porn.xxx/">porn.xxx (both placeholder pages, safe for work) are now resolving under the new TLD. href="http://xxx.xxx/">xxx.xxx is resolving as well.
